By The Bye

English Law: By the Bye in the Past

A declaration may be filed without a new process or writ, when the defendant is in court in another case, by the plaintiff in that case having filed common bail for him; the declaration therefore, filed is called a declaration by the bye. 1 Crompt. 96; Lee’s Diet. of Pr.
