Commissioner Meaning
Commissioner in Scottish Law
A lawyer, judge, sheriff or other suitable person who hears evidence at a different time or place to the actual court case. The evidence can then be used during the court case.
Commissioner in relation with the Courts and Tribunals in England
There are 15 Judicial Appointments Commission Commissioners, including a Chairman. Twelve of these (including the Chairman) are appointed through open competition. The other three are selected by the Judges’ Council or Tribunals’ Council. The Chairman of the Commission must always be a lay member. Of the 14 other Commissioners:
• five must be judicial members
• two must be professional members (each of which must hold a professional qualification as a solicitor, barrister or Fellow of the Chartered Institute of Legal Executives, but must not hold the same qualification as each other)
• five must be lay members
• one must be a tribunal judge
• one must be a non-legally qualified judicial member.
