Court Settlement Process in relation to the Technology and Construction Court

[rtbs name=”technology-and-construction-court”]The Court Settlement Process is a form of mediation carried out by Technology and Construction Court judges. Whilst mediation may be carried out by any appropriately qualified person, in an appropriate case, and with the consent of all parties, a Technology and Construction Court judge may act as a Settlement Judge pursuant to a Court Settlement Order in the terms set out in this legal Encyclopedia. This has proved to be successful in many cases. If the parties would like to consider the use of the Technology and Construction Court Settlement Process or would like further information, they should contact the Technology and Construction Court Registry in London or the Technology and Construction Court Liaison District Judges in the Technology and Construction Court centres outside London. Where, following a request from the parties, the assigned Technology and Construction Court judge considers that the parties might be able to achieve an amicable settlement and that a Technology and Construction Court judge is particularly able to assist in achieving that settlement, that judge or another Technology and Construction Court judge, with the agreement of the parties, will make a Court Settlement Order (this legal Encyclopedia) embodying the parties’ agreement and fixing a date for the Technology and Construction Court Settlement Conference to take place with an estimated duration proportionate to the issues in the case. The Technology and Construction Court judge appointed as the Settlement Judge will then conduct the Technology and Construction Court Settlement Process in accordance with that Court Settlement Order in a similar manner to that of a mediator. If no settlement is achieved then the case would proceed but, if the assigned judge carried out the Technology and Construction Court Settlement Process, then the case would be assigned to another Technology and Construction Court judge. In any event, the Settlement Judge would take no further part in the Technology and Construction Court proceedings.
