Definition of Double Probate

In accordance with the work A Dictionary of Law, this is a description of Double Probate : A second grant of *probate in respect of the same estate in favour of an executor who was not a party to the first grant. This occurs when the executor has not renounced his executorship and has a power to apply for a grant of probate at a later time than the original grant.
