Equal Merit Provision in relation with the Courts and Tribunals in England
Where there are two or more candidates of equal merit, a candidate may be selected for a post by the Judicial Appointments Commission (JAC), a non-departmental public body, for the purpose of increasing judicial diversity. (Brought in under the Crime and Courts Act 2013). All candidates considered under the equal merit provision must first be considered by the Judicial Appointments Commission (JAC), a non-departmental public body,’s Board to be selectable in their own right.
