Concept of Not Found

Traditional meaning of not found [1] in scots law: Not guilty: a plea of the general issue in trespass, case, and criminal causes; 3rd Book (“Of Private Wrongs”), Blackstone’s Commentaries on the Laws of England 305. Not possessed: a plea of specific traverse in trover, denjdng that the plaintiff was possessed of the goods at the time of action brought. Not proven: a Scotch verdict in criminal cases, having the legal effect of a verdict of not guilty, but leaving the prisoner under suspicion. [rtbs name=”scottish-law”]
