The Pre-Trial Review Timing and Attendance in relation to the Technology and Construction Court

[rtbs name=”technology-and-construction-court”]The Pre-Trial Review (“Pre-trial Review”) will usually be fixed for a date that is 4-6 weeks in advance of the commencement of the trial itself. It is vital that the advocates, who are going to conduct the trial, should attend the Pre-trial Review and every effort should be made to achieve this. It is usually appropriate for the Pre-trial Review to be conducted by way of an oral hearing or, at the very least, a telephone conference, so that the judge may raise matters of trial management even if the parties can agree beforehand any outstanding directions and the detailed requirements for the management of the trial. In appropriate cases, e.g. where the amount in issue is disproportionate to the costs of a full trial, the judge may wish to consider with the parties whether there are other ways in which the dispute might be resolved.
