Commencement and transfer Service in relation to the Technology and Construction Court

[rtbs name=”technology-and-construction-court”]Claim forms issued in the Technology and Construction Court at the Rolls Building in London are to be served by the claimant, not by the Registry. In some other court centres claim forms are served by the court, unless the claimant specifically requests otherwise. The different methods of service are set out in Civil Procedure Rules Part 6 and the accompanying Practice Direction. Applications for an extension of time in which to serve a claim form are governed by Civil Procedure Rules 7.6 and there are only limited grounds on which such extensions of time are granted. The evidence required on an application for an extension of time is set out in paragraph 8.2 of Practice Direction A supplementing Civil Procedure Rules Part 7. When the claimant has served the claim form, he must file a certificate of service: Civil Procedure Rules 6.17 (2). This is necessary if, for instance, the claimant wishes to obtain judgment in default (Civil Procedure Rules Part 12). Applications for permission to serve a claim form out of the jurisdiction are subject to Civil Procedure Rules 6.30-6.47 inclusive.
