Definition of Family Life

In accordance with the work A Dictionary of Law, this is a description of Family Life : A right set out in Article 8 of the European Convention on Human Rights and now part of UK law as a consequence of the *Human Rights Act 1998. The right to family life extends beyond formal relationships and legitimate arrangements. This right is a *qualified right; as such, the public interest can be used to justify an interference with it providing that this is prescribed by law, designed for a legitimate purpose, and proportionate. Public authorities have a limited but positive duty to protect family life from interference by third parties. The right to found a family (the right to procreation) is contained in Article 12 of the Convention.
