In accordance with the work A Dictionary of Law, this is a description of Freedom From Encumbrance : The freedom of property from the binding rights of parties other than the owner. In contracts for the sale of goods, unless the seller makes it clear that he is contracting to transfer only such title as he or a third person may have, there is an implied *warranty that the goods are free from any charge or encumbrance not disclosed or known to the buyer before the contract was made.
